The Spouses of Accident Victims May Also Have a Claim for Damages

Often accident victims are so physically or emotionally incapacitated that they are unable to interact with their husband or wife the way they did previously. In situations like this the spouse of the injury victim has his or her own claim against the individual who caused the accident.

The legal term for such a claim is loss of consortium. This means that the spouse of the injury victims has a claim for the loss of his or her injured partners services, society and companionship. Perhaps the best known example of such a claim is the husband or wife who loses the sexual companionship of their injured partner. However, a loss of consortium claim may also apply to the emotional loss a spouse sustains when they are no longer able to engage in the type of activities with their injured spouse that they did before the accident.
